Terms of Service

These Terms of Service ("Terms") govern your use of CyberStudy (https://cyberstudy.io), operated by Will Hertz as a sole proprietor doing business as CyberStudy ("we", "us", "operator"). By creating an account or using the service, you agree to these Terms.

1. The service

CyberStudy is a free study tool for Cisco and CompTIA networking certifications. It provides practice questions, concept explanations, a Cisco IOS command-line simulator, and a final-exam simulation. It is a personal learning project, not a commercial product. We make no promises about uptime, accuracy of study material, or fitness for any particular certification.

2. Eligibility

You must be at least 16 years old to use CyberStudy. If you are in the United States, you must be at least 13 years old; users aged 13-15 may use the service only with the involvement of a parent or guardian.

3. Your account

You're responsible for the security of your password. Use a strong, unique one.
You're responsible for activity that happens under your account.
You may delete your account at any time from the Account page.
We may suspend or terminate accounts that violate these Terms.

4. Acceptable use

You agree not to:

Use the service for any unlawful purpose.
Attempt to gain unauthorized access to other users' accounts, our servers, or any other system.
Disrupt the service through automated abuse, denial-of-service attacks, or excessive scraping.
Use the service to send spam, malware, or harmful content.
Reverse-engineer the service to discover proprietary information not already publicly disclosed.
Copy or redistribute the study content in bulk for commercial purposes.

5. Content and intellectual property

The study content (questions, explanations, diagrams, scripts) is original work by the operator unless otherwise attributed. You may use it personally to study for certifications. You may not republish or sell the content.

"Cisco", "CCNA", "CCNP", and related marks are trademarks of Cisco Systems, Inc. "CompTIA", "Network+", "Security+", and related marks are trademarks of CompTIA, Inc. CyberStudy is not affiliated with, endorsed by, or sponsored by Cisco Systems or CompTIA. The content is independently produced for educational purposes.

Notes and highlights you create within CyberStudy belong to you. We won't use them for any purpose other than displaying them back to you.

6. Free service; no warranty

CyberStudy is provided free of charge, as-is, and without warranty.

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT THE STUDY CONTENT IS ACCURATE OR SUFFICIENT TO PASS ANY CERTIFICATION EXAM.

7. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE OPERATOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR USE OF OR INABILITY TO USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT. IF, NOTWITHSTANDING THE ABOVE, THE OPERATOR IS FOUND LIABLE TO YOU, TOTAL LIABILITY IS LIMITED TO ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER. SINCE THE SERVICE IS FREE, THE AMOUNT YOU PAID US IS $0.

8. Indemnification

You agree to defend and hold the operator harmless from any claims arising from your misuse of the service or violation of these Terms.

9. Changes to the service

We may add, change, or remove features at any time. We may also discontinue the service entirely. If we do, we'll give you at least 30 days' notice and an opportunity to export your data.

10. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent change. For material changes, we will notify signed-in users by email at least 14 days before the change takes effect. Continued use of the service after the effective date constitutes acceptance.

11. Governing law

These Terms are governed by the laws of the State of Alabama, United States, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or use of the service will be resolved in the courts of Lee County, Alabama, unless you reside in a jurisdiction that grants you the right to file in your local courts.

12. Termination

You may stop using the service at any time and delete your account. We may suspend or terminate your access to the service for any violation of these Terms. Sections 5 (intellectual property), 6 (no warranty), 7 (limitation of liability), 8 (indemnification), and 11 (governing law) survive termination.
